well, kevin saw the doc last week and they said he will probably have to have half of his miniscus cartilage removed. he thought he would be able to have his surgery right away. but, workman’s comp has to check out everything first—he had a past MRI 5 years ago on this knee—no real damage. turns out it could be 2-4 weeks before he has his surgery.
they were going to decide if he could do some sort of light duty at work before his surgery. he had been told a little while ago that he needed to learn about the electrical and refrigeration parts of the dairy, which he really hadn’t learned yet—although his maintainence work was excellent.today his boss called for him to come talk to him, and the higher ups decided they were going to let him go. so, we are once again without a job and my husband is not in any position physically to get a new job since he is waiting for major surgery and then will have to have rehab after that.we will have to pay for cobra insurance, since i am in the middle of trying to figure out what is happening with my adrenals and can’t afford to have a break in insurance.i can’t believe we could have so many things go wrong—-just one thing after another. i am really trying not to get discouraged.June 22, 2009 at 3:16 pm #63019AnonymousInactivewait! they can’t let him go because he got hurt on the job! you have a claim for short term disability and a lawsuit if he got hurt then they fired him! Call a lawyer!!!!!!!!!!!!
June 22, 2009 at 4:29 pm #63020AnonymousInactivethey are giving the reason for letting him go because of job performance—they HAD told him that he was a little behind in learning the refridgeration and electrical parts of the job—but he had been studying it and his local boss did not want to let him go. he had not even had a long enough time since his “warning” to have learned those things completely. we figured that while he was out with his surgery he would be able to study and get it learned. it was when they discovered he was going to be gone longer than we originally thought that they decided to let him go.
kevin feels like it is bcause of the type of injury he got and because of his age—-but there is no way to prove it, especially since he had been told he needed to learn those other parts of the job better. he would always have been in danger of reinjuring his knee. his boss wants to make sure he gets unemployement—whenever he is eligible for it, but if they put the reason for termination as poor job performance (his performance was actually excellent, he just hadn’t learned everything yet) he may not be able to get unemployment. his local boss had been telling him that right now was the best time for him to be gone since the price of milk is gone, that i think he will put not enough work as their reason for letting him go to make sure that kevin can get unemployement. i think his local boss really hated to have to tell him they were letting him go. he had told kevin that as far as he was concerned his job was not in danger—-but this came from the higher ups.we get severence pay until july 5, which means we get our insurance coverage until the end of july. kevin would never consider a legal issue because he could never prove it—and even if he could, he wouldn’t do it.right now we are trying to figure out how and when we are supposed to apply for unemployement since he will be on workmans comp for an unknown amount of time. do we let them know he lost his job, but is coverd by workmans comp. for now, or do we wait until the workmans comp is done to report that he lost his job—creates kind of a dilema for us, since if he was on unemployement he couldn’t do the required job hunting because he doesn’t know when he will be having surgery or how long before he can work after surgery. is he eligible for both workmans comp and unemployement?kevin isn’t one for sitting at a desk—but i tell you, the man is gifted when it comes to building things—especially for someone who never had any formal training for that kind of stuff. but, he is almost 53 years old and has 2 bad knees–kind of cuts him down on what he can do.i am so physically exhausted and in pain so much of the time that i am basically worthless—man, life can be frustrating at times!!!!!!! thanks for letting me rant and rant!!!!there is no way i can work right now—i have been getting sicker and sicker. i really hope my adrenal tests show something because it can be treated.June 22, 2009 at 4:32 pm #63021AnonymousInactiveare either or both of you elidgable for disability? not sure if that would be more than comp or unemployment…..

June 22, 2009 at 5:13 pm #63022AnonymousInactivei haven’t worked enough hours in my lifetime to be eligible for disability—and kevin would only be eligible for temporary disability—and i think workmans comp is more.
i have thought at times that i should try and work a little while i can to build up enough hours in case i should happen to reach a point where i needed to apply for disability. i can’t remember how many more hours i need, but i don’t think it was a ton. substitute teaching would be a good choice, i think—especially if i only subbed at the high school or jr high. we have A and B days of 4 classes each. every teacher teaches 3 classes each day and then gets one free classtime for prep. if i am subbing, that prep time is usually free time for me. i used to run errands, crochet or rest during that time. doing that would probably be the easiest and least streassful for me. really, though, i would just like to figure out what is wrong with me and get better!!!!!!!! i feel like such a lousy mother these days.
